A recent Employment Relations Authority case has found that an employee who repeatedly drank alcohol while at work was wrongly sacked.

The employer commenced a disciplinary process over the drinking, but sacked the employee without properly completing the process when he failed to attend the disciplinary meeting.

The employee brought a personal grievance alleging unjustified dismissal and it was held that this failure of process meant the dismissal was unjustified (it would have been fine if the process had been properly completed).

The ERA refused to award any compensation because the employee brought it all upon himself.
