The key elements of the policy are as follows:

  • The foreshore and seabed will be vested in the Crown.
  • Provision is made for the recognition of ancestral connection of Maori to particular areas of the foreshore and seabed.
  • Provision is also made for the recognition and protection of existing customary rights to undertake particular activities, uses and practices.
  • The policy provides for redress after application to the High Court or through direct approach to the government for groups that can prove territorial customary rights.
  • The right of public access and navigation along and over the foreshore and seabed is preserved.
