An employee had their fingers crushed when they reached inside a steel press to operate it.  The guard had been left off the machine that morning after it was set up for use.

The employer should have ensured the guard was fitted and ensured that removal of the guard disabled the machine from operating.  It also needed to better train its employees on safe use of the machine.

The company pleaded not guilty but was convicted and fined $61,000 plus ordered to pay $8,000 reparation.
