Partner Alan Knowsley was recently interviewed on More FM by Jay-Jay and Flynny on the legal position if employees on annual leave get sick (eg with Covid) while on leave. 

If the employee has already started the leave, then annual leave can be converted to sick leave with the employer’s agreement. 

If the annual leave has not yet started, an employer must convert the leave to sick leave, if the employee requests. The same applies in advance of starting annual leave if the employee suffers a bereavement or qualifies for family violence leave. 

If the leave has started the employer must convert annual leave into bereavement or domestic violence leave if the employee qualifies and asks the employer to do so.
