Philip is the chairman of a Body Corporate which has been badly run for many years. Since the changes to the law regarding unit titles came in (in the form of the Unit Titles Act 2010), Philip has been attempting to tidy up how it is run.  He recently sent out a Notice of Annual Meeting.

He was contacted by two members of the Body Corporate to say that his notice was invalid because he missed out various details required by the Unit Titles Regulations. The Body Corporate therefore wouldn’t have been able to validly pass any resolutions at the AGM, and Philip had to cancel the planned meeting and start the process again.

If you are chairperson of a Body Corporate it pays to be aware of all requirements in relation to timing of notices of meetings, as well as what needs to be included in notices, to ensure your Body Corporate is within the law.
