An employee of a spray painting company was injured due to substandard breathing equipment.
Employers have a duty to ensure the safety of employees in the workplace. The employer had a duty to ensure that while at work the employee was not exposed to hazards in or near their place of work and under the employer’s control.
The spray painting company was found to be in breach and was fined $15,000 and ordered to pay $20,000 compensation for the injury the employee suffered.
