Employee complaints of racial abuse fail…
An employee has failed in his claim of unjustified disadvantage. He claimed that his employer should have dealt with allegations he raised on numerous occasions of racial abuse by his supervisor. The Employment Relations Authority dismissed the claims despite the employee producing several abusive texts from his supervisor.
The ERA held that the employee had failed to tell his employer of the abusive texts (except one minor one) and so the employer had no opportunity to deal with the problem.
