Employees penalised for competing with employer during employment…
The Employment Relations Authority has found that two employees of a building company set up a company in opposition to their employer and quoted for work and accepted work while they were employed. That work was of a nature that the employer carried out and the employer had also been asked to quote for those two jobs.
The employees were each penalised $4,000 for their breach of duty to the employer not to compete while employed. The penalties were ordered to be paid to the employer in lieu of damages.
