A company director has been found liable by the Employment Relations Authority to personally pay $75,000 of wage arrears plus a $50,000 penalty following unpaid wages.

The employee regularly worked more hours than they were contracted to but was not paid for overtime.  This meant the minimum wage was not paid for the time worked.

The employer also refused requests for leave and required the employee to attend work even when sick.

The employer liquidated their company after the Labour Inspector took action but the ERA held that the director should be made personally liable for all the arrears and the penalty.
