A truck driver was struck and killed by another vehicle at his workplace.  Rather than prosecute the employer WorkSafe has entered into an enforceable undertaking with the employer to reduce the risk of harm.  The company will contribute to technology and methodology to understand the risks and prevent similar accidents happening again and for training employees and workers.  The employer will also fund a youth alcohol and drug programme and make reparations to the deceased’s family.

The overall costs of the undertaking is nearly $1,000,000 to the employer.

The investment of the employer in this undertaking is likely to be higher than the penalties that would have been imposed if the company had been prosecuted. It is a significant commitment to improving the safety of their workplace and other workplaces which will benefit from the research undertaken.
