The only female employee at a workshop lodged allegations against her former co-worker of sexual harassment in the workplace.

The woman reported an instance where her colleague allegedly touched her waist, thigh, and the side of her buttock. Furthermore, she claimed her co-worker peered at her through a hole in the toilet wall.

These incidents, as well as almost two years of more subtle forms of sexual misconduct, prompted her to resign.

Despite seeking help from her employer and the police, she faced financial strain and immigration status uncertainty.

The Tribunal ruled in her favour, because, despite denials from the co-worker, her recollection of events was credible, whereas the inconsistent versions put forward by her colleague were not believable.

The Tribunal awarded her $29,000 in compensation for humiliation, loss of dignity, and injury to feelings and nearly $3000 in lost wages.

The Tribunal stressed the illegality of sexual harassment in the workplace under the Human Rights Act, finding his behaviour offensive and sexual.
