The Licensed Building Practitioners Board has convicted a builder for not providing a record of work upon completion of their restricted building work.

The builder was engaged to carry out work on foundations of a residential building. Before the work was concluded a dispute arose and the contract was terminated. The builder did not provide a record of work to the owner or council.

The Board found that the builder's work was completed due to the termination of the contract, even though the foundations were not completed.

The existence of a dispute and a Disputes Tribunal Claim does not excuse a builder from providing a record of work.

The builder was also found to have failed to provide a written building contract as the work exceeded the $30,000 threshold.

The builder was fined $2,500 and ordered to pay costs.
