Builder fined $2,500 for ignoring building consent rules...
The owner of a property complained to the Licensed Building Practitioners Board because of their builder’s negligent supervision and work.
The builder was contracted to construct an extension to the property which included demolishing and remodelling parts of the property. The builder carried out work which was contrary to the Council consented plans and did not obtain engineering advice until after carrying out the faulty work.
The builder also changed the design of work from what the owners wanted. For example, the owners wanted a staircase design with a sliding door but the builder constructed a swinging door instead. While the builder stated that a sliding door was not possible, he failed to consult a designer for other options.
The Board found that the builder’s errors were negligent and serious enough to be a breach of the Building Act. The Board fined the builder $2,500 and ordered him to pay $3,500 for the costs of the Board’s inquiry.
If you are concerned with negligent building work carried out on your property, it pays to obtain legal advice from a legal professional to explore your options in remedying the work or recovering costs from the builder.
