The Licensed Building Practitioners Board has found a builder guilty of multiple breaches of the Building Act an ordered to him to undergo specified training within two years. If he fails to complete the training, his building license will be suspended until he completes the training.

The Board considered the builder, as a supervisor of non-licensed people, had not competently supervised them and was negligent in that supervision. He allowed his employer (not a LBP) to direct work and failed to ensure work done complied with the building consent and code. He also failed to provide a record of work upon completion.

They also found the builder to be in breach of the code of ethics because he failed to ensure that the building work complied with the health and safety legislation.

The Board decided that a training order was the most appropriate penalty and ordered him to undertake a construction supervisor course within two years.

Another interesting finding of the Board related to the builder’s denial that he knew or had supervised one of the workers on the site. It transpired that the person he denied knowing was actually his brother. That denial cannot have assisted his credibility with the Board.
