The Privacy Commissioner has upheld a complaint about a breach of privacy in relation to a photo of a person on an office wall.

The photo was pinned up where it could be seen through a window from the public reception area.  The subject of the photo was recognised and she was told that it was on the wall.

The photo had been pinned to the wall for many years and no one could remember why it was on the wall in the first place and why it was still there.

There were two privacy breaches in this situation.  Firstly putting the photo where it could be seen by the public and secondly leaving it up when the purpose for displaying it no longer existed.

The agency apologised for the breaches and removed the photo.  It declined to pay any compensation.
