Towing vehicles - when can’t a car be towed from private land...
Alan Knowsley was recently asked to comment for a Stuff article on the towing away of a car with the driver present at the time. It is not legal to tow a car when the driver is present for illegal parking on private property.
The old common law remedy of “Distress damage feasant” referred to in the article is the self-help remedy an owner of land can exercise to impound a chattel wrongfully on land (eg a car), to recover the cost of damage caused by the chattel.
