A customer was booked to go on a cruise with a connecting flight to the city the cruise departed from.  He learnt before the flight that there were problems with the engines on planes flown by the airline.  He attempted to get confirmation from the airline as to whether the flight would go ahead or not, but the airline could not confirm in advance as to whether or not the flight would take place. 

Not wishing to miss his cruise he decided not to fly and instead took a train for 10 hours to get to the point of departure on the cruise.  He made it to the cruise on time, but then discovered that the plane flight had actually occurred as scheduled.

The insurer declined his claim for the extra costs of the travel to Auckland and a night’s accommodation, because the changes to his travel plans were not necessary as the flight went ahead.
