The Insurance and Financial Savings Ombudsman has rejected a complaint from an insured after their house was damaged by a fire.

When they took out their insurance they failed to tell the insurer that they had a previous claim for burglary declined and had their insurance policy cancelled.  They had been asked to declare any declined claims and cancelled policies within the last five years and they had failed to give the correct information.

The Ombudsman held that this was a breach of their policy and the insurer was entitled to decline the claim entirely. The “insured” was therefore not insured and as a result was out of pocket for all the repairs to their house.
